  • Breath-testing machines: The prosecution’s reliance on highly inaccurate and often improperly calibrated machines that claim to measure the amount of blood in a person’s breath is one of the most common ways that prosecution builds a case.  These machines are notoriously unreliable, are subject to a number of variables that can influence them against the defendant and must be operated by technicians that know the ins-and-outs of the machines in order to get the best sample possible for the state.
  • Police arrest techniques:  The arrest scenario is not designed to be a calming and soothing experience.  Flashing lights, loud sirens, intense questioning, strange machines, and the overall threat of being arrested for a serious crime can intimidate anyone into saying and doing just about anything.  This disorienting experience can often influence the outcome of a roadside sobriety test, and make an innocent person appear guilty.
  • Roadside conditions:  A darkened road with cars rushing past is hardly the place to test someone’s poise and coordination, but police, nevertheless assert that confused and probably frightened people can maintain their composure in spite of these distractions.  Uneven and wet roads and pavement, wind, bright and fast-moving headlights, and the ever-present fear of making a mistake can consign an innocent person to a night in jail
  • Outside chemical influences:  There are literally hundreds of chemicals that can bias an alcohol testing machine.  For example, smokers have a higher concentration of acetaldehyde, a chemical that can register on a breathalyzer but is not the result of recent alcohol consumption.  Another potentially tainting variable is the presence of gastroesphogeal reflux disease (GERD), the side effect of which can make the defendant appear to have ingested alcohol when they have not.  It takes seasoned and experienced DUI defense lawyers to present these extenuating circumstances to a jury, and Essen, Essen, Susaneck, & Cohen, P.A have used these arguments and others to preserve the freedom of thousands of people throughout South Florida and across the state, over the past 50 years.

Meet Richard Essen

Richard Essen graduated from the University of Miami in 1960 before attending the university’s School of Law.  He was quickly admitted to the Florida Bar after receiving his J.D. in 1963, and is a member of the bar of the State of New York and the District of Columbia.  Mr. Essen is also admitted to practice in U.S. District Court Southern District of Florida, U.S. Court of Appeals 2nd Circuit, U.S. Court of Appeals 11th Circuit, and the U.S. Supreme Court.
